Reason for Recommended Action/Background
A local agency’s conflict of interest code must reflect the current structure of the organization and properly identify officials and employees who should be filing Statements of Economic Interests (Form 700s). A code tells public officials, governmental employees, and consultants what financial interests they must disclose on their Form 700s and helps to provide transparency in local government as required under the Political Reform Act.
The Board of Supervisors is the code reviewing body under state law for special districts and certain other agencies solely contained within the boundaries of Yolo County, including Reclamation District #1600 (Attachment A), Yolo County Housing (Attachment B) and the Yolo County Transportation District (Attachment C). As such, it is legally responsible for reviewing and approving the conflict of interest codes adopted by these special districts and local agencies. These codes include all language currently required by law. Under Government Code Section 87309, a conflict of interest code or amendment shall not be approved by the Board of Supervisors if it: (a) Fails to provide reasonable assurance that all foreseeable potential conflict of interest situations will be disclosed or prevented; (b) Fails to provide to each affected person a clear and specific statement of that person’s duties under the code; or (c) Fails to adequately differentiate between designated employees with different powers and responsibilities. The Office of the County Counsel believes that it is appropriate for the Board of Supervisors to approve these codes.
