Reason for Recommended Action/Background
Under NEPA, federal agencies responsible for conducting the environmental review of a project may sometimes have an obligation to complete the review “in cooperation with state and local governments.” Staff recommends the Board send the attached letter (Att. A) requesting such "cooperating agency" status in regard to the Comprehensive Study of the Sacramento River, Yolo Bypass System (Yolo Bypass Comprehensive Study) which is currently being led by the Army Corps of Engineers along with a request for funding for such participation. This study was authorized in the Water Resources Development Act of 2020 to envision future system changes and various projects, including the potential expansion of the Yolo Bypass. The County has previously served as a cooperating agency under NEPA for other major projects affecting the Yolo Bypass and surrounding areas, including the Yolo Bypass Salmonid Habitat Restoration and Fish Passage Project (2013) and the Bay-Delta Conservation Plan (2010).
