Recommended Action
- Approve memorandum of understanding (MOU) with Sutter Davis Hospital (SDH) for the roles and responsibilities of administering and distributing Maddy and Richie Emergency Medical Services (EMS) funds, for the period of the MOU’s Effective Date until terminated; and
- Delegate authority to the Director of Health and Human Services Agency, or designee, to sign and execute any additional forms, documents and/or amendments as necessary relating to this MOU.

Reason for Recommended Action/Background
Health and Safety Code Section 1797.98a authorizes counties to establish a Maddy EMS Fund to provide funding for physicians and surgeons in hospitals for costs of uncompensated emergency care and other discretionary EMS purposes.
Health and Safety Code Section 1797.98a(e) authorizes counties to establish a Richie Fund as part of the Maddy EMS Fund to provide additional funding for hospitals that specialize in services to children physicians and surgeons who provide emergency care for children.
The funding is generated through the Collections of Penalty Assessments. Maddy Funds (Original Assessment) and Richie Funds (Supplemental Assessment) are collected by $2 for every $10 collected in fines, penalties and forfeitures for criminal offenses and $2 for every $7 collected from traffic violator school. County will distribute the collected fees to SDH, less fifteen percent (15%) reserve funds to support the delivery of trauma and emergency medical care services in the county and improving and increasing access for pediatric emergency services in our emergency departments.
SDH will receive an initial funding disbursement based on their emergency department's patient volume from last quarter. The ongoing funding disbursed to SDHs will be based on their submitted quarterly patient census reports in their emergency department.
