Recommended Action

  1. Approve revenue-generating agreement with Bradley Tanks Inc. for liquid waste disposal at the Yolo County Central Landfill for an initial term of July 1, 2025 to June 30, 2027, with the option to extend for up to two additional years; and
     
  2. Authorize the Chair of the Board of Supervisors to sign the agreement.

Reason for Recommended Action/Background

Yolo County previously had an agreement with Bradley Tanks, Inc. (BTI) for the disposal of liquid waste, which was in place from April 22, 2021, to June 30, 2025. The new agreement builds off of the previous agreement, with increased liquid waste tonnage in the form of hydroexcavated soil (mud), expected from BTI's normal operations, as well as from their Master Service Agreement with Pacific Gas & Electric (PG&E) (MSA BTI587). The mud is generated from various utility excavations by way of a water and vacuum system, which ensures utilities such as power and gas are not damaged during the excavation process. Often, the areas excavated have low levels of petroleum contamination, which necessitates this waste to be disposed of at a permitted facility equipped with proper containment features, such as the Yolo County Central Landfill. This agreement is for a minimum of 18,000 and a maximum of 108,000 tons per year.

The BTI agreement is for a base term of two years, with up to two additional 1-year extensions at the option of the County. Revenue at the guaranteed minimum of 18,000 tons annually is $2,238,000. However, Landfill staff anticipate that BTI will continue to bring in its current annual average of about 28,000 tons. At 28,000 tons per year, revenue would increase to approximately $3,500,000, which was included in the Division's Fiscal Year 25-26 budget. The revenue collected as part of this agreement is used to cover the cost of properly handling this material and offset the general overhead costs of operating the Landfill. In addition, the majority of BTI's liquid waste is from out-of-county sources, which would result in a minimum of $18,000, but an anticipated $28,000 in additional funds going to the County's Climate Action and Adaptability Plan (CAAP) in the form of out-of-county tip fee surcharges. The Landfill charges out-of-county customers $1/ton on all liquid waste, and waste that does not fall under SB 1383. The revenue generated from this surcharge is then passed onto the Sustainability Division to further County greenhouse gas reduction efforts in the area of transportation emissions.

Revenue at the required minimum 18,000 tons annually is $2,238,000. However, staff anticipates actual revenue will be approximately $3,500,000 based on historical quantities brought to the landfill by BTI.
