Approve third amendment to Agreement No. 1546 with SCI, Inc. extending the term of the agreement through August 31, 2026, to develop engineers' reports and perform Proposition 218 elections for willing fire protection districts. (No general funding impact) (Webb/Espitia)

Recommended Action

  1. Approve third amendment to Agreement No. 1546 with SCI, Inc. extending the term of the agreement through August 31, 2026, to develop engineers' reports and perform Proposition 218 elections for willing fire protection districts; and
     
  2. Authorize the Manager of Procurement to execute the third amendment.

Reason for Recommended Action/Background

Staff recommends that the Board approve the third amendment to the agreement with SCI Consulting to allow time to conclude current Proposition 218 and update assessment fees for No Man's Land and East Davis Fire Protection Districts next summer. This request is for an extension of time only and no additional funds are requested.  

Background

In May 2022, the County entered into an agreement with SCI Consulting to develop engineers' reports and perform Proposition 218 elections for willing fire protection districts. This effort was supported by cannabis tax revenues and Contingency Funding. On March 12, 2024, the Board of Supervisors approved the first amendment to Agreement No. 1546 with SCI, Inc., which increased the maximum compensation for Proposition 218 Planning, Assessment Engineering, Balloting, and Community Outreach to $344,527. The agreement term was also extended through June 30, 2025. On November 12, 2024, the Board approved a Second Amendment for a reduction of $21,254 to the SCI, Inc. contract for a total maximum of $332,773 (includes separate a task for Elkhorn FPD Cost-of-Service Study) due to a change in the consultant selected by Clarksburg FPD. In addition, the Board approved Clarksburg FPD's request to use the remaining funds of $21,254 to conduct the election, outreach, collateral materials, etc. with its selected consultant, DCC Engineering Co., Inc. As of today, nine Fire Protection Districts have completed a Proposition 218 election, six of which were successful, and three of which were not. Direct service Fire Protection Districts that successfully pass new Proposition 218 assessments are eligible for County matching funds set aside $1.5M in general fund revenues for rural fire protection sustainability.

The following districts are undertaking Proposition 218 elections this summer (2025):

  • Clarksburg FPD (Passed)
