Approve fourth amendment to Agreement No. 21-275 for services related to the Wild Wings Wood Duck Pump Station with Luhdorff and Scalmanini Consulting Engineers (LSCE) to extend the term for one additional year through December 31, 2026, and to set the construction engineering assistance compensation at $29,984; and approve fifth amendment to Agreement No. 19-253 with LSCE for the engineering and design of the arsenic treatment facility at the Wild Wings County Service Area to extend the term through February 28, 2026, and to increase the maximum compensation by $18,664 for a new contract maximum of $433,069. Recommended Action

  1. Approve fourth amendment to Agreement No. 21-275 for services related to the Wild Wings Wood Duck Pump Station with Luhdorff and Scalmanini Consulting Engineers (LSCE) to extend the term for one additional year through December 31, 2026 and to set the construction engineering assistance compensation at $29,984 (Attachment B); and
     
  2. Approve fifth amendment to Agreement No. 19-253 with LSCE for the engineering and design of the arsenic treatment facility at the Wild Wings County Service Area to extend the term through February 28, 2026 and to increase the maximum compensation by $18,664 for a new contract maximum of $433,069 (Attachment D).

Reason for Recommended Action/Background

Wood Duck Pump Station Agreement: On or about November 9, 2021, the County entered into an agreement with LSCE for engineering and design services of a new well in the Wild Wings County Service Area (CSA) (Attachment A).  LSCE proceeded to design the new well. However, due to cost concerns surrounding the bidding process the well had to be redesigned (value engineered) and phased. LSCE's scope of work was modified to account for this additional work.  LSCE has completed its phased design of the new well and construction on the initial phase of the well is currently in progress.  The proposed Fourth Amendment to Agreement No. 21-275 (Attachment B) extends the term for one additional year through December 31, 2026, to allow for LSCE to assist County staff with construction engineering activities such as responses to submittals and requests for information.  The proposed Fourth Amendment also formalizes the budget for these construction phase activities at $29,984.  The proposed amendment simply sets the budget for these additional services but will not increase the maximum compensation authorized by the Agreement, which will remain at $864,678, as approved by the Board of Supervisors on May 21, 2024 with Amendment No. 2 to Agreement No. 21-275.

Arsenic Agreement: On or about December 17, 2019, the County entered into an agreement with LSCE for design and construction assistance of an arsenic treatment facility in the Wild Wings County Service Area (Attachment C). The term of the agreement has been extended several times due to delays in the project.  In 2023, LSCE completed the plans and specifications for the arsenic facility and the project was posted for bids.  Construction has been in progress for the last two years and is currently in the punchlist stage.  The proposed Fifth Amendment to Agreement No. 19-253 (Attachment D) will extend the term of the agreement until February 28, 2026 and increase the maximum compensation by $18,664 in order to allow LSCE to provide continued construction engineering oversight and closeout assistance.

Competitive Bid Process/Vendor Performance

A competitive bid process was completed in 2019 for the arsenic contract and in 2021 for the new well contract.  Luhdorff & Scalmanini Consulting Engineers, Inc. was the selected bidder for both contracts. 

The Department confirms Luhdorff and Scalmanini Consulting Engineers, Inc. has performed satisfactorily on the current agreements.

Agreement No. 21-275 sets the construction engineering assistance compensation at $29,984. This amount has already been incorporated into the FY 25-26 budget for the Wild Wings Water Fund and adopted by the Board of Supervisors as part of the annual budget approval process.

Agreement No. 19-253 has an estimated fiscal impact of $18,664, which will be covered by the fund balance in the Wild Wings Water Fund as adopted by the Board of Supervisors as part of the annual budget approval process.
