Approve agreement with Ramon Lomeli, an unmarried man, for the purchase of interest in real property (“Agreement”) in the amount of $29,200 for acquisition of a temporary construction easement necessary for the Knights Landing Flood Mitigation Project; and authorize the Director of Public Works to sign the Agreement and take the administrative actions necessary to complete the easement acquisition. Recommended Action

  1. Approve agreement with Ramon Lomeli, an unmarried man, for the purchase of interest in real property in the amount of $29,200 for acquisition of a temporary construction easement necessary for the Knights Landing Flood Mitigation Project; and
     
  2. Authorize the Director of Public Works to sign the Agreement and take the administrative actions necessary to complete the easement acquisition.

Reason for Recommended Action/Background

A temporary construction easement is required on private property for the Knights Landing Flood Mitigation Project (“Project”). The County and its consultant team (“Project Team”) have determined that the Project will require the acquisition of certain property interests on Assessor’s Parcel Number 056-282-003 (“Subject Property”). This parcel is owned by Ramon Lomeli (“Property Owner”).
 
An independent appraisal was prepared by Pattison & Associates, Inc. to determine the value of the easement interests on the Subject Property. The Project Team then worked with the Property Owner to reach a mutually acceptable agreement regarding the purchase and compensation of the easement interests. The resulting agreement is included as Attachment A. The $29,200 cost of the agreement is fully reimbursable through grant funds available to the County.
 
Background

The County has received two grants to implement the Project with includes a series of drainage and levee improvements to the Sacramento River Right Bank Levee and the Knights Landing Ridge Cut that protect the community of Knights Landing. The Project addresses under-seepage, through-seepage, erosion, stability, and freeboard deficiencies along the two levee systems. Improvements to these levees will reduce flood risk in the area and provide the community with 100-year level flood protection.
 
In October 2020, the County was awarded approximately $15.8 million through the California Department of Water Resources’ Small Communities Flood Risk Reduction Program to initiate project design, permitting, real estate acquisition, and construction of select components. This grant requires a local match, and to date the County has committed $1.75 million toward that requirement.
 
In July 2023, the County received approximately $6.8 million in Phase 1 funding through the Federal Emergency Management Agency’s Hazard Mitigation Grant Program and the California Governor’s Office of Emergency Services’ Prepare California Match Program. Once all Phase 1 deliverables, which include 100% design, real estate acquisition, permitting, and federal cultural and environmental compliance, are completed, the County is expected to receive an additional ~$30.5 million from FEMA in Phase 2 funding for Project construction. The FEMA and CalOES programs provide full funding for the Project, so the County is not required to contribute funds for this portion of the work.
 
Implementation of the Project will reduce or prevent flooding for an estimated population of 1,117 (2020), protect approximately 408 residential and agricultural structures, and safeguard about 3,100 acres of prime agricultural land.
 
Proposed Easement Acquisition
 
The Subject Property is located south of the Sacramento River Right Bank Levee, on the north side of 4th Street (Highway 45), just west of Highway 113. Its address is listed as 42142 4th Street, Knights Landing, CA. The Subject Property contains approximately 0.33 acre, is zoned High Density Residential (R-H), and is generally vacant except for a chain-link security fence and some personal property (i.e., a travel trailer). The County seeks to acquire a 36-month temporary construction easement (TCE) covering the entire 0.33-acre Subject Property to support implementation of the Project.
 
Environmental Review
 
On October 22, 2024, the Board of Supervisors adopted an Initial Study/Mitigated Negative Declaration (SCH #2024050218) for the overall Knights Landing Flood Management Project as the appropriate level of environmental review in accordance with the California Environmental Quality Act (CEQA).
 
As part of FEMA’s Application Approval, HMGP DR-4482-900-12, Phase 1 dated July 17, 2023, FEMA identifies that the Phase 1 activities and deliverable include Land Purchasing. The associated Record of Environmental Considerations (REC) determined that Phase 1 of this project has been determined to be Categorically Excluded from the need to prepare either an Environmental Impact Statement or Environmental Assessment in accordance with FEMA Instruction 108-1-1 and FEMA Directive 108-1-1 as authorized by DHS Instruction Manual 023-01-001-01, Revision 1 regarding implementation of the National Environmental Policy Act of 1969 (NEPA), as amended and the Council on Environmental Quality (CEQ) regulations for implementation procedural provisions of NEPA.

The $29,200 cost of the agreement is fully reimbursable through grant funds available to the County, with a federal share of 90% and a non-federal share of 10% that is covered by CalOES. There is no net cost to the County to acquire the easement. All expenditures related to this action have been fully budgeted in the County’s Fiscal Year 2025–2026 budget.

The Agreement total reflects only the purchase price of the easement interests. Additional title, escrow, and recording related charges may be incurred in securing the easements. These additional charges are typically nominal (approximately 10% of the purchase price).
