Approve and authorize the Chair to sign Agreement No. 25-79021-000 with the California Department of State Hospitals in the amount of $4,948,384 for the period of January 1, 2026 through December 31, 2028 for the provision of Jail-Based Competency Treatment Project. (No general fund impact) (Morales)

Over the past several years, there has been a steady increase in the number of felony incompetent to stand trial (IST) clients referred to the Department of State Hospital (DSH) for competency restoration due to inadequate capacity in the existing State Hospitals. This has led to a significant backlog of clients throughout the State waiting in jail for months at a time until placement can be made at a State Hospital bed. As a result, the DSH has been working with the State and various counties to increase statewide capacity for local treatment options. These options include Jail Based Competency Treatment (JBCT) programs. The purpose of the JBCT program is for the restoration of competency to certain felony patient inmates deemed IST under Penal Code section 1370 to occur locally in the jail rather than in a State Hospital for those determined to be appropriate. 

This agreement provides funding for a dedicated Correctional Officer (CO) assigned to the JBCT program. This is a critical component to a JBCT program, as there are often individuals receiving JBCT services who have different classifications, require supportive oversight, and have a dedicated Correctional Officer who receives specific training as part of the overall JBCT team, increasing the effectiveness of the program. This agreement will also provide the Sheriff Department with funding for the overall housing costs associated with these seven (7) beds.

This revenue contract also reduces our DSH growth cap penalty and helps the community by restoring individuals locally without the high costs of state hospitalization.

Yolo County Health and Human Services Agency will be the lead department and receive the funds from this agreement. The funding for the Sheriff Department will be provided via an interdepartmental Memorandum of Understanding and the internal billing process.
