Reason for Recommended Action/Background

The agenda item is intended to amend Chapter 10 of Title 3, Articles 1-3 of the Yolo County Code concerning Commercial Weighing and Measuring Devices (Device Registration) and the Point of Sale and Inspection Program (POS Program) through adoption of the ordinance in Attachment A. The Board approved the Commercial Weighing and Measuring Devices in December of 1987 and the Point of Sale Inspection ordinance in June of 2003. The adopted, currently codified versions are included as Attachment B, and a track changes version is included as Attachment C. The primary changes are:
  • Placing both Device Registration fees and Point of Sale (POS) inspection fees on one annual invoice.
  • Adds/clarifies definitions for “Person” and “Department," and consolidates the definitions section in Article 1 (which currently occupies Article 1 without any other substantive provisions) with Article 2. Articles 1-3 become Articles 1-2 as a result of the consolidation. 
  • Registration certificates will now expire on December 31st instead of January 31st.
  • Late fees for device registration and POS inspection fees changed to percentage-based tiers.
  • Re-inspection fees established at the Sealer’s hourly rate for weights and measures devices and POS systems.
  • Clarifies that annual POS inspections occur if resources allow and may include Re-inspection fees for devices that fail initial inspection.
  • Updates violation and penalty structure, including infraction/misdemeanor designations and fine amounts.
The department is proposing these ordinance changes to promote efficiencies by combining Device Registration and POS fees on one annual invoice. Our goal is to improve collection rates through this effort.  Over the last two fiscal years staff have spent 228 hours locating and contacting clients with past due accounts in an attempt to collect these payments, resulting in an estimated operational loss of $32,000.

County Counsel has approved the current form of the ordinance. The updated ordinance will be shared with stakeholders prior to the meeting on October 6, 2026 to give ample time for review and to provide feedback to the County.
