Approve the following two contract amendments with Luhdorff and Scalmanini Consulting Engineers (LSCE): 1) fifth amendment to Agreement No. 21-275 for services related to the Wild Wings Wood Duck Pump Station to increase the maximum compensation by $7,000 for a new contract maximum $36,984 to complete construction-phase engineering services; and 2) sixth amendment to Agreement No. 19-253 for the engineering and design of the arsenic treatment facility at the Wild Wings County Service Area to increase the maximum compensation by $6,000 for a new contract maximum of $439,069 and extend the term to December 31, 2026. Recommended Action

Reason for Recommended Action/Background
Wood Duck Pump Station Agreement: On or about November 9, 2021, the County entered into an agreement with LSCE for engineering and design services of a new well in the Wild Wings County Service Area (CSA) (Attachment A). LSCE proceeded to design the new well. However, due to cost concerns surrounding the bidding process, the well had to be redesigned (value engineered) and phased. LSCE's scope of work was modified to account for this additional work. LSCE has completed its phased design of the new well and construction on the initial phase of the well is currently in progress. The proposed Fifth Amendment to Agreement No. 21-275 (Attachment B) allows for LSCE to continue assisting County staff with construction engineering activities including, reviewing the remaining contactor submittals, responding to requests for information, coordinating with the construction manager, Alpha CM, and providing technical support during equipment startup and commissioning. Construction for the Wood Duck Well and Pump Station is in progress and is expected to be complete by December 31, 2026.
Arsenic Agreement: On or about December 17, 2019, the County entered into an agreement with LSCE for design and construction assistance of an arsenic treatment facility in the Wild Wings County Service Area (Attachment D). The term of the agreement has been extended several times due to delays in the project. In 2023, LSCE completed the plans and specifications for the arsenic facility and the project was posted for bids.Construction has been in progress for the last two years and is expected to be complete by October 31, 2026. The proposed Sixth Amendment to Agreement No. 19-253 (Attachment D) will extend the term of the agreement until December 31, 2026, and increase the maximum compensation by $6,000 in order to allow LSCE to provide continued construction engineering oversight, inspections, and closeout the Project.

Competitive Bid Process/Vendor Performance
A competitive bid process was completed in 2019 for the arsenic contract and in 2021 for the new well contract. Luhdorff & Scalmanini Consulting Engineers, Inc. was the selected bidder for both contracts.

There is no general fund impact as a result of this action. Expenses will be covered by the fund balance in the Wild Wings CSA Water Fund as adopted by the Board of Supervisors as part of the annual budget approval process.
The total cost of recommended action is $13,000 which is comprised of a $7,000 increase to contract 21-275 with LSCE and a $6,000 increase to contract 19-253 related to the arsenic treatment facility. Total compensation for the 2 contracts including amendments will be $476,053.
